I don't think you even have to mention that. They a) don't want to lose a customer and their reputation and b) don't want you to even think about persuing legal actions, therefore bribing you with a shitload of chocolate.
Srsly, just send them the chocolate with package and the fingernail or call them or something. I'm 90% sure you will recieve a ton of candy.

Speaking as one of the guys who used to take calls like that - everyone says "Oh I will threaten to sue them and get all kinds of free stuff/money!" EVERYONE. You can practically hear the gears spinning in their heads. 'I'm such a playa', they say to themselves.
Don't bother; it makes you sound like a grasping opportunist and in any case, noone cares. They don't care if you were sick, they don't care if you sue, and they sure as hell don't care if you never buy their shit ever again.
On the one hand, they're certainly working for some sub-contractor in Dubai or somewhere, and on the other, you're a terrible customer. The kind who calls them up and complains and makes them spend money and resources they'd rather keep. They call those sorts of customers 'demons', and they're widely considered not worth keeping.
Bottom line - do whatever you want. Noone will care.
