When it comes to Pierrot vs. the Penguin, it's less that they're supposed to be the same so much that a lot of batman's villains are warped, evil versions of generally silly things. Joker and Harley are clowns, there's the Mad Hatter, Penguin is short, fat, and makes piles of bird puns, and all of these villains are still very dangerous, when i think scarecrow i generally think of the stupid one from Wizard of Oz, but Batman's scarecrow fights with powdered nightmares. Pierrot is also dressed up almost comically, uses a prop cane as a gun, has the mind of a child and has an irrational fear of cats, and is far and away the most frightening, dangerous thing in the series. Likewise the final fight of Pierrot Le Fou takes place in an abandoned theme park and most viewers recall this episode as being one of the most frightening because of the perversion of these images of cartoon animals only half-lit with the carnival music only playing at half speed.
