I've got a question about the Golden Age Heros.

Why are some Golden Age superheros in the public domain and some aren't?

All of the Marvel and DC licenses are still owned(Captain America/Bucky/Alan Scott/Jay Gerric), how come the characters in say "Project Superpowers" or "Terra Obscura" weren't bought by some big comic company years ago?
