You can use whatever the hell hell you want as reference. You can't blatantly copy (that's not referencing).

If you draw it, and not used actual photo in some kind of photomanipulation, you dont need to worry

I'm really just using it as an example it could be anything. A cat driving a f-16 anything I don't care I'm just curious. No tracing or anything legit drawing it.

Google "copyright fair use". with appropriation you need to change the meaning or intent of the original piece somewhat. You could still be sued of course (which isnt going to happen), but you have a defense. Look at warhol's work. That being said we arent laywers, so if you plan on slapping the image on a tshirt and selling 1000 copies, you might want to ask one.
