The amount of things that need to align for not only a charge in cases like that or even similar cases is astronomical. You need a group of cops who are either militantly against all forms of "rape" not to qualify it or under pressure to crack down on the rapes in their
district.In most cases though they'll "File a report", lol, which no one will care about. You need a State prosecutor who isn't overworked and doesn't think this is a waste of time which 90% of them will and they have to think it is winnable because who wants to deal with a guaranteed loss on their record, especially if the job is just a stepping stone.
Then you need a judge who also doesn't think it is a waste of time, which again they will have seen a lot of these claims in their history so they most likely will think it is a waste of the Taxpayer's money. Then they have to get a jury that is sooooo unbelievably ignorant of social situations, politics and the trend of fake rape accusations which they also see on TV a lot. So maybe .1% of cases will go through to the end and maybe .0001% will lead to a conviction with little to no jail time.
Think about all the new PSA's that show two people at a party, they get drunk and have sex, the girl whispers a barely audible no from across the room then puts up no struggle after making out some more and then they call it "rape". If people were actually getting convicted in these circumstances, that would be deterrent enough. But they aren't so they are attacking it at its source
