You can create potions of 3rd or lower level.

This is written this way because the prerequisite is ability to cast 3rd level spell right? You can make potions of 4th level spells and such I assume?

Spells of higher than 3rd level don't fit their magic into potions, so no. You cannot brew potions of 4th level spells.

Nope. Brew Potion requires caster level 3. Spell level has nothing to do with that. You can brew potions of any spell you can cast, up to spell level 3. Potions never come in spells higher than level 3.

Assuming 3.5? Nope, it means you can only make potions of spells of 3rd level or lower. This is supported by page 229 of the DMG, which states (first paragraph under "Potions and Oils", 3rd & 4th sentences):

"A potion or Oil can be used only once. It can duplicate the effect of spell of up to 3rd level that has a casting time of less than 1 minute."

Wands are similarly limited to spells of 4th level or lower. (page 245 of the DMG, first sentence under "Wands"). I do not believe any other type of magic Item that duplicates a spell effect has a level limitation.

Relying on potions to get things done isn't that good of an idea, unless your DM gives you unlimited resources and time. Otherwise, you'll end up consuming most of your wealth while your other party members buy/craft/loot/steal less flashy, but more reliable (and permanent) items.

It was a flavor > mechanics (obviously, since it won't work at all) kind of set up focusing on using various poisons and offensive spells in potion/oil form and using those slathered on thrown weapons.

An idea I got excited about and wanted to run with before I really looked into if it was possible at all, let alone effective. Rookie mistake.

Ask your GM to waive the "level 3 or lower" rule, and play as an artificer so you get some amount of free crafting.

There is a way....a prestige class in Magic of Eberron. The Alchemist Savant. I think it can make some high level potions.

That... Actually sounds like a rather cool idea. But I can't think of any way to accomplish that off hand (assuming you want spells of higher than 3rd level, anyway). Perhaps someone else around here can figure out how to get something to work similarly to that?

I swore there was a Greater spellstoring enchantment somewhere...

Page 32 of the Eberron campaign setting. There's a longer explanation there, but that's the important bit for your question

Just looked through it. There didn't appear to be anything that increased the level of potions your could brew. It did make it so you could make 3 potions in a day where you could normally only make 1 though.

There's a skill upgrade suggested in Excalibur for this effect, since in Arthurian settings mages are much more about cauldrons and enchanted shit than they are about fireballs and lightning bolts.

Basically, you can craft potions of up to 3rd level with just the feat, and then you can add 1 level for every 5 full ranks of Craft: Alchemy you possess. So you can go all the way to 7th level spells at level 17 if you max it out. Note that crafting high level spells may require you to still pay for any exorbitant material costs or XP costs.

They also had a feat I've used for a couple different mages; it lets you craft a potion in 1 hour per spell level at twice the XP cost.

If you check out Craft Talisman in Oriental Adventures its essentially a brew potion that isn't capped at lvl 3. Only catch, which is stated in the feat description but is stated in the magic item section, is that talismans can only be made in consecrated or desecrated areas.
