Is it legal to have a Lord in a army of less than 2000 points provided he does not go over the 25% base rule?

Also, when you buy magic items for a character, do these count towards your army total, or just the 50/100 points characters are allowed to take, it being assumed that the magic items are part of the hero/lord's cost?
