The bottom line is that it's not really about what's fair, and it's not even about rules, it's about whatever the company wants.
While companies CAN get away with suing people for even innocuous things, other times when the offense is more severe they still will not take action. Get a C&D for making a non-profit video game mod just because it's competition for your shitty licensed alternative, but another company let's you make recast parts and stickers.
Arguing heatedly about rules when the company is not enforcing them is just a social hate-fuck; not that a calm and rational version of the same discussion isn't acceptable, even if it's still very hypothetical.
