The rules of toydom

So, I am considering making my own toys from scratch with some experience under my belt, however, I always wondered about the legal implications of, lets say, using a marvel character. I understand that, customs wise, you can sort of get away with it as long as your implying its made BY the company nor mass produced. But the legal implications of lets say casting an all original model but using the spiderman character as the subject matter. More or less, does anyone know what I can get away with and what can start getting me stop and desist letters?
