Hey guys,

So, it looks like lots of whiny GOPers are declaring the mandate unconstitutional (Romney gets a pass for some reason). The way this is playing out is done in such a fashion that is designed to eventually demand the Supreme Court rule on the issue.

What do you think is going to happen? Do you believe the entire law will be deemed unconstitutional, or just the mandate?

Striking down the mandate would be a nightmare, as premiums would rise to considerably high levels.

So far, the Justice dept. hasn't filed an appeal, so the law is null and void as of right now.
Assuming they will file an appeal, it doesn't matter if the Supremes strike down just the mandate. It will have the same effect as striking down the whole thing because the funding for all of it is predicated on the mandate being enforced.

Most political movements dissipate when they achieve their objectives because they are run largely by ordinary people directly affected by a problem in society and they are almost purely motivated by policy. If there were a proper universal healthcare law that was passed which allowed an "opt-out clause" for anyone who wanted private insurance for whatever reason, this wouldn't be a problem.

If government can force us to buy car insurance I'm pretty sure there's nothing unconstitutional about making us health insurance. I just want a government healthcare that will set a competitive pricing bar out there that will lower the overpriced healthcare rates out there. Creating a new public healthcare will create more public jobs, lower prices in the private sector, improve quality through regulations, lower the deficit, and make its own gravy and bacon! What's not to like?

Also, there is nothing in the constitution that forces us to buy car insurance... but, people still have to buy liability insurance in CA (I don't know about other states). Driving is a privilege not a right. Which makes it alright for the state government to make people buy this type of insurance in order to protect others in case they become harmed in any way (car accident).

But, the Constitution is not perfect. There are amendments created to accommodate changes within it. Oregon and Texas challenged the 26th Amendment as unconstitutional because it limited the voting age to no more than 18 years old.
Although challenged at the Supreme Court, it was later passed because of the increasing pressure during the Vietnam War. Hence the slogan: Old enough to fight, old enough to vote. I'm not saying government is forcing us to vote, I'm saying that the way we perceive things can ultimately change with time. Alcohol prohibition (XVII Amendment) included.

What I learned?
1) Forcing others to buy health insurance is not in the constitution. Correct.

2) Should government force us to buy health insurance. Not a good idea. But the consequences of it can ultimately be beneficial to everybody because it helps lowers health costs to both patients and hospital bills if everybody is covered by insurance.

3) New amendments could allow this. Although very unlikely.

4) Should there still be a government run health care. Absolutely. Nothing unconstitutional about that.

It's all about money and power. Those who have the most money have the most power. It's a power struggle between gov't and coporations. Niether one has the good of "the people" at heart so it doesn't matter who wins.
The gov't wants to co-op health care to get all that money. If the gov't was truly a fair arbiter for The people vs. corporations, they could enact laws that would bring the cost of health care way down BUT THEY DON't because they want the money, which brings them more power.

You don't have to be given the right by the constitution, something is unconstitutional when the constitution prevents you from doing something, if the constitution doesn't mention insurance it means you can do pretty much anything about insurance (accordingly with the rest of the constit)
